The Real Estate (Regulation and Development) Act, 2016 — RERA — was created to make new real estate projects more transparent. In Rajasthan it is implemented by the Rajasthan Real Estate Regulatory Authority. If you are booking a flat or plot in a new project in Jaipur or Sikar, these are the points that matter.
Which projects must register?
Under the Act, a promoter must register a project with RERA before advertising or selling it, unless it is exempt. Projects where the land is up to 500 square metres, or with up to eight apartments, are generally exempt (states can set lower thresholds), as are projects that already had a completion certificate before the Act came into force.
What to check on the RERA website
- Registration number — it should appear in every advertisement and brochure. Search it on the Rajasthan RERA website.
- Project details — approved plans, number of units, carpet areas and the promoter's declared completion date.
- Approvals and title — uploaded approval documents and the land title.
- Progress updates — promoters are required to update construction progress on the portal.
- Complaints — check whether the project or promoter has complaints or orders against it.
Key protections for buyers
- Carpet area pricing: prices must be based on carpet area, as defined in the Act.
- Separate account: a large share (70%) of money collected from buyers must be kept in a separate bank account and used only for that project's land and construction.
- Limit on advance: a promoter cannot take more than 10% of the price as an advance before a registered agreement for sale.
- Delay compensation: if possession is delayed beyond the agreed date, the buyer can claim interest or a refund as provided in the Act.
- Structural defects: promoters are responsible for fixing structural defects reported within five years of possession.
RERA and resale homes
RERA mainly governs new projects sold by promoters. For resale flats and independent houses, focus on title and approval documents — see our document checklist.
Always read the current rules and your project's page on the official Rajasthan RERA portal; this guide is a summary, not legal advice.
